STEP F - Register Photos with the Copyright Office
DISCLAIMER: I'm not a lawyer. I've just successfully removed my photos from websites through a copyright infringement claim. Please know that while this does work, it's not a permanent solution to the problem, as the perpetrator can continually post your photos on other sites. Remember that the best way to stop Revenge Porn is through the signing of a petition.
A quick note on copyright law:
According to federal law, if you take a photograph, you own the copyright to that photograph. You do not have to do anything in order to copyright the photo; the copyright already exists. But, if you want to ensure that nobody uses the photograph without your permission, you can register the copyright with the copyright office.
Once notice is given to the website owner, or in circumstances where the website owner discovers the infringing material itself, it is required to expeditiously remove, or disable access to, the material. For more on copyright law, click here and here. If the website owner refuses to take down the material, submit a Copyright Infringement Claim to Google, Yahoo, and Bing. Unlike some website owners, they actually respond to you and will disable all links to your copyrighted photos, usually within one day (See Step I, the index to the right of this post).
How to Register Your Copyright
❑ If you don't have the photos on your computer or phone anymore, download all of the nude/non-nude photos onto your desktop.
❑ Create a file folder called "Untitled Images" and drag the photos into this folder.
❑ Go to the Register of Copyright Office.
❑ Create a username and password.
❑ Follow the instructions to register the copyright to your images (This will cost you $35, but you will be able to upload a bunch of images ).
❑ Type of case: "Work of Visual Arts" (because they are photographs).
❑ Title: "Untitled Images" (or really, title it whatever you want).
❑ Author/Creator: If you took the photo, then you are the author. So, check "yes."
❑ Upload all of your images.
❑ At the end of the process, you will receive a copyright registration case number that corresponds to your images. Keep it safely on file. Remember your user name and password so that you can always access your copyrighted material and the registration case number.
